1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and REFATHOM Inc. ("REFATHOM," "we," "us," or "our"), governing your access to and use of the REFATHOM website located at refathom.com and refathom.space, the REFATHOM Neuro-Performance Academy platform, and all associated programs, products, content, and services (collectively, the "Services").

By accessing or using our Services, purchasing any program, or creating an account, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

REFATHOM provides neuro-performance training programs, digital content, workshops, speaking engagements, and executive coaching services. Our current offerings include, but are not limited to:

Activate Your Secret Genius™ (AYSG™) — 12-Week Neuro-Performance Master Program (Individual / B2C, Leadership Cohort, and Enterprise editions)
Unlock Your Brilliant Brain™ — Corporate Neuro-Performance Workshop
Executive Coaching — Private neuro-performance coaching (available exclusively to current and graduate AYSG™ students)
Digital resources, lead magnets, and supplementary training materials
Keynote speaking and organizational training partnerships

Program offerings, pricing, and availability are subject to change. REFATHOM reserves the right to modify, discontinue, or update any program or service at any time without prior notice.

3. User Accounts

To access certain Services, you must create an account on the REFATHOM platform (hosted on Kajabi). You agree to:

Provide accurate, current, and complete information during registration
Maintain the security of your password and account credentials
Notify us immediately of any unauthorized use of your account
Take responsibility for all activity that occurs under your account

You may not share your account login credentials with any other person. Your account is for your individual use only, except where a corporate or group enrollment has been explicitly arranged with REFATHOM in writing.

4. Purchases and Payment

4.1 Pricing

All prices are listed in US Dollars (USD) unless otherwise specified. Current program pricing is as follows:

Activate Your Secret Genius™ (Individual): $2,488 (payment plans available)
Unlock Your Brilliant Brain™ (Corporate Workshop): $1,188
Leadership Cohort and Executive Coaching: Pricing provided upon inquiry

REFATHOM reserves the right to change pricing at any time. Price changes will not affect purchases already completed.

4.2 Payment Processing

Payments are processed through secure third-party payment processors. REFATHOM does not store your full credit card information. By purchasing, you authorize us to charge the total amount due at the time of purchase, including any applicable taxes.

4.3 Payment Plans

Where payment plans are offered, you agree to all installment charges as specified at the time of purchase. Failure to complete installment payments may result in suspension or termination of your program access until the outstanding balance is resolved.

5. Refund Policy

Due to the digital nature of our programs and the immediate access provided upon purchase, all sales are generally final. We do not offer refunds except in the following circumstances:

You have not accessed any program content and request a refund within 48 hours of purchase
There was a verified technical error that prevented access to the program
Duplicate purchase occurred due to a documented system error

Refund requests must be submitted in writing to [SUPPORT EMAIL — TO BE CONFIRMED] within the applicable window. REFATHOM reserves the right to evaluate all refund requests on a case-by-case basis. Approved refunds will be processed within 10 business days to the original payment method.

No refunds are available for Leadership Cohort live sessions already attended, corporate workshop engagements already delivered, or executive coaching sessions already completed.

6. Intellectual Property

All content within the REFATHOM Services — including but not limited to the REFATHOM™ methodology, training frameworks, program curriculum, lesson content, videos, audio recordings, workbooks, assessments, executive summaries, proprietary frameworks (including but not limited to the VUCA framework applications, FATE framework, Keystones of Daily Harmony™, and all AYSG™ program content), written materials, graphics, logos, and branding — is the exclusive intellectual property of REFATHOM Inc. and is protected by applicable copyright, trademark, trade secret, and intellectual property laws.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, personal license to access and use the program content solely for your own personal development. This license does not include the right to:

Copy, reproduce, distribute, or share any program content with any third party
Teach, re-sell, or create derivative works based on REFATHOM content
Share your account login with others to provide access to program content
Record, screenshot, or capture program videos or live sessions for any purpose
Use any REFATHOM methodology, framework, or content in your own professional offerings without prior written authorization from REFATHOM Inc.

REFATHOM takes the protection of its intellectual property seriously. Unauthorized use, reproduction, or distribution of REFATHOM content may result in immediate termination of your account and legal action.

7. Program Access and Delivery

Digital programs are delivered through the REFATHOM Neuro-Performance Academy platform. Upon purchase and payment confirmation, you will receive login credentials to access your program.

Unless otherwise specified, AYSG™ program participants receive lifetime access to their enrolled program content, including all future updates made to that program. "Lifetime access" means for as long as REFATHOM maintains the platform and the program remains active.

REFATHOM reserves the right to modify, update, or improve program content at any time. Significant structural changes to a purchased program will be communicated to enrolled participants.

Access to live cohort sessions, group coaching, and executive coaching is time-limited and session-specific. Missed live sessions are not automatically refunded or rescheduled unless REFATHOM cancels a session.

8. User Conduct

By using our Services, you agree not to:

Violate any applicable laws or regulations
Share copyrighted program content without authorization
Harass, threaten, or harm other users or REFATHOM staff
Attempt to gain unauthorized access to any portion of the platform
Use the Services for any commercial purpose without prior written consent from REFATHOM
Post or transmit false, misleading, or defamatory information about REFATHOM or its programs

REFATHOM reserves the right to suspend or terminate access to any user who violates these Terms.

9. Disclaimer of Warranties

REFATHOM's programs and content are educational and informational in nature. They are not a substitute for professional medical, psychological, psychiatric, legal, or financial advice.

Results from participation in REFATHOM programs vary by individual. REFATHOM does not guarantee specific outcomes, improvements, or results. Testimonials shared on our platform represent individual experiences and are not guarantees of similar outcomes for all participants.

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.

10. Limitation of Liability

To the maximum extent permitted by law, REFATHOM Inc., its founders, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, loss of profits, or personal injury.

REFATHOM's total liability to you for any claim arising from the use of our Services shall not exceed the amount you paid to REFATHOM in the twelve (12) months preceding the claim.

11. Corporate and B2B Engagements

Organizations engaging REFATHOM for corporate training, keynote speaking, or organizational partnerships agree to additional terms outlined in their specific service agreement or contract. In the event of conflict between these Terms and a signed organizational agreement, the signed agreement shall govern.

Corporate clients are responsible for ensuring that all enrolled employees or participants comply with these Terms regarding intellectual property and authorized use of program content.

12. Affiliate Program

REFATHOM operates an Alumni Ambassador affiliate program available to graduates of AYSG™. Participants in the affiliate program are bound by separate Affiliate Terms provided at enrollment into the program. All affiliate promotion must direct users through the official REFATHOM platform and may not misrepresent the nature, scope, or outcomes of any REFATHOM program.

13. Privacy

Your use of the Services is also governed by our Privacy Policy, incorporated herein by reference. Please review our Privacy Policy to understand our data practices.

14. Changes to Terms

REFATHOM reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

15. Governing Law
